EU Court Rejects Microsoft Lawsuit

The European Court of First Instance in Luxembourg today confirmed a decision by the EU Commission to fine Microsoft 497 million euros.

The Commission set the penalty three years ago for abuse of monopoly. The decision centered on the integration of Media Player with the operating system, which almost pushed the competitive product, Realplayer off the market. The Commission also forced Microsoft to offer a version of its operating system without Media Player, although sales of this version were low.

Besides the fine, the judges also confirmed Microsoft's obligation to disclose parts of its source code to competitors to allow them to gear their software for improved operating system support. However, Microsoft will not be forced to appoint an independent auditor to monitor compliance with the decision, says the court. Microsoft can still appeal against the decision at the European Court.
